High Times - Navigating a Drug Free Workplace in Light of Marijuana Use Laws and Restrictions on Post-Accident Testing

During this one-hour session, we will provide a broad overview of the various medical marijuana use laws in Virginia. We will discuss the various protections such medical marijuana use laws may provide to employees, and we will provide a roadmap on how to navigate through the difficult issues which arise with an employee using medical marijuana. We will discuss what an employer can and cannot do without running afoul of the Americans with Disability Act or state disability discrimination laws when it learns an employee is a registered medical marijuana user. Lastly, we will spend some time discussing how some post-accident drug testing policies may be in violation of OSHA’s anti-retaliation rule, which went into effect last year.

PHILIP J. SIEGEL is a Partner and shareholder with the firm. Philip attended the University of Michigan in Ann Arbor, graduating with distinction from the School of Business Administration where he earned his B.B.A. Mr. Siegel received his law degree from Emory University School of Law. After working in the public accounting industry as a state and local tax consultant for two years, he commenced his career as a construction litigation and labor/employment attorney.

Mr. Siegel’s practice focuses primarily in the areas of labor/employment law, including defense of OSHA citations, contract consulting, and construction litigation, including representation of general contractors, subcontractors and suppliers, all on a national basis.

Philip has represented clients in the construction industry before the National Labor Relations Board, the Occupational Safety and Health Review Commission, the Department of Labor, and the Equal Employment Opportunity Commission.

Mr. Siegel has lectured on construction topics to a wide range of groups, including seminars sponsored by Lorman Educational Seminars, the Arizona Roofing Contractors Association, the Georgia Roofing & Sheetmetal Contractors Association, the Georgia Concrete and Products Association, the Macon Economic Development Commission Safety Committee, and the National Roofing Legal Resource Center.
